LEGAL NOTICE Village of Mechanicsburg RESOLUTION 24-1 EMERGENCY RESOLUTION REQUESTING PLANNING COMMISSION TO PROVIDE FURTHER STUDY AND ADDRESS CONCERNS REGARDING PREVIOUSLY-PROPOSED FOOD TRUCK ORDINANCE WHEREAS , The Mechanicsburg Planning Commission previously proposed an Ordinance regulating Food Truck licensing and operations within the Village of Mechanicsburg; and WHEREAS , at a public hearing held on October 21, 2024, numerous questions were raised relating to specific concerns relating to the implementation of said Ordinance; and WHEREAS , during a vote held after 3 readings and following the public hearing, the Village Council rejected the proposed Ordinance by the requisite % majority; and WHEREAS , various members felt that specific details were not sufficiently addressed to allow the proposal to become a workable ordinance; WHEREAS , the Village Council still remains interested to establish regulations procedures for Food Truck Operation within the corporate limits of the Village; and WHEREAS, t he following concerns were raised during the public hearing: a. Recognition of the fact that brick and mortar businesses have a significant commitment to a long term presence in the Village of Mechanicsburg b. Recognition of the fact that brick and mortar businesses already present in the Village of Mechanicsburg should not be placed at an economic or regulatory disadvantage to transient Food Trucks in the Village. c. Diversity of food options in the Village of Mechanicsburg is desirable. d. Food trucks should be permitted during harvest time for farmers at Heritage. e. Previous proposal was too broad and presented opportunities for loopholes. f. Fees and duration of permits needs to be clarified. g. Taxes on wages and profits are handled differently for Food Trucks and Brick and Mortar restaurants. h. Worry about permanent or perpetual placement of a Food Truck on a rented or purchased private lot. NOW BE IT THEREFORE RESOLVED by the Council of the Village of Mechanicsburg, Ohio,that the Planning Commission is hereby requested to re-examine its previously submitted Food Truck Proposal, in light of the above concerns, and to address the following: 1. Reevaluate whether permanent Food Truck placement on private property should be permitted and .evaluate what changes would need to be made in the current zoning code to allow this.
